Acceptance of These Terms

These Terms of Use constitute an agreement between you and Joy for Life, Inc. concerning your access to and use of joy4life.org, any page or service made available through that website, and any related digital experience operated by or on behalf of Joy for Life.

By accessing the website, submitting information, creating an account, joining Red Thread, making a donation, purchasing merchandise, or otherwise using our online services, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree to these Terms, do not use the website or its associated services.

Eligibility and Authority

You may browse publicly available portions of the website without creating an account. To make a purchase, establish a paid membership, enter into a recurring payment arrangement, or otherwise enter into a binding transaction, you must be at least 18 years old or have the involvement and authorization of a parent or legal guardian.

If you use the website on behalf of an organization, business, foundation, donor-advised fund, or other entity, you represent that you have authority to bind that entity to these Terms.

About Joy for Life

Joy for Life, Inc. is an Oregon nonprofit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code.

Joy for Life develops programs, initiatives, communities, and experiences centered on meaningful connection, personal purpose, participation, belonging, and the philosophy represented by the Red Thread of Fate.

References in these Terms to “Joy for Life,” “J4L,” “we,” “us,” or “our” mean Joy for Life, Inc. References to “you” or “your” mean the person or entity accessing or using the website or services.

Permitted Use of the Website

You may use the website for lawful, personal, informational, philanthropic, and transactional purposes consistent with these Terms.

Subject to these Terms, Joy for Life grants you a limited, revocable, nonexclusive, nontransferable license to access and use the website and its publicly available content for your own lawful, noncommercial use.

This license does not transfer ownership of any website content, branding, design, software, image, recording, publication, or other intellectual property.

Prohibited Conduct

You may not use the website or related services to:

• Violate any applicable law, regulation, court order, or contractual obligation.
• Impersonate another person or entity, misrepresent your affiliation, or submit false or misleading information.
• Attempt to gain unauthorized access to an account, server, database, administrative area, payment system, or other restricted resource.
• Introduce malware, malicious code, automated attacks, harmful files, or technologies intended to disrupt, damage, monitor, or interfere with the website or another user.
• Scrape, crawl, harvest, extract, reproduce, index, or aggregate website content through automated means without our prior written authorization.
• Copy, republish, sell, license, distribute, modify, publicly display, or commercially exploit protected Joy for Life content without authorization.
• Circumvent access controls, membership restrictions, payment requirements, technological protections, or content-security measures.
• Share private Red Thread content, recordings, account credentials, member information, or restricted materials with nonmembers.
• Harass, threaten, defame, exploit, discriminate against, or unlawfully interfere with another person.
• Use the website in a way that could impair its availability, integrity, security, performance, or reputation.

Accounts and Account Security

Certain services may require you to create an account through Joy for Life or a third-party platform. You agree to provide current, complete, and accurate information and to update that information when necessary.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. You may not sell, transfer, license, lend, or share your account with another person.

Notify us promptly at info@joy4life.org if you believe that your account or credentials have been compromised.

Red Thread Membership

Red Thread is Joy for Life’s private membership community. Membership may include access to private content, member discussions, livestreams, live question-and-answer sessions, behind-the-scenes materials, first-look content, and other experiences described on the membership page.

Membership availability

Membership features, presenters, schedules, content frequency, platform functionality, and benefits may change as the community develops. Unless expressly stated otherwise, membership does not guarantee a particular number of posts, broadcasts, events, responses, interactions, or appearances.

Billing

When you purchase a recurring membership, you authorize the applicable payment processor to charge the payment method you provide at the disclosed interval until you cancel or the membership is otherwise terminated.

Cancellation

You may cancel recurring membership billing through the member account or platform made available for that purpose. Unless otherwise stated during checkout, cancellation prevents future renewal charges and access ordinarily remains available through the end of the current paid billing period.

Member conduct and confidentiality

Private membership content is provided for the personal use of the member who purchased access. Recording, reproducing, distributing, reposting, publishing, transmitting, selling, or sharing private member content without written permission is prohibited.

Members must respect the privacy, dignity, intellectual property, and personal information of other members, guests, participants, volunteers, staff, and contributors.

Removal from the community

Joy for Life may restrict, suspend, or terminate membership access when reasonably necessary to address nonpayment, account sharing, unauthorized distribution, harassment, unlawful conduct, disruption, security concerns, or a material violation of these Terms.

Donations

Donations support the charitable mission and activities of Joy for Life. Donors may be given the opportunity to express a preference for a particular fund, program, participant-support category, campaign, or initiative.

Unless Joy for Life expressly agrees in writing that a gift is legally restricted, donor designations are treated as preferences. Joy for Life retains the discretion and control necessary to use donated funds in furtherance of its charitable purposes and applicable legal obligations.

Recurring donations

By selecting a recurring donation, you authorize the applicable payment processor to charge the selected amount at the disclosed interval until the recurring donation is canceled.

Tax treatment

Contributions may be tax-deductible to the extent permitted by law. The deductibility of a particular payment depends on the donor’s circumstances and whether the donor receives goods, services, membership benefits, admission, merchandise, or other value in connection with the payment.

Joy for Life does not provide individual tax, accounting, or legal advice. Donors should consult their own professional advisers regarding the treatment of a contribution.

Refunds and corrections

Completed charitable donations are generally final. Requests involving duplicate charges, processing errors, unauthorized transactions, or other exceptional circumstances will be reviewed individually.

Merchandise and Store Transactions

Joy for Life may offer apparel, accessories, printed materials, or other merchandise through its website. Product appearance, color, scale, placement, and other characteristics may vary slightly from digital previews.

Product availability is not guaranteed. We may limit quantities, correct pricing or description errors, reject an order, or cancel an order when reasonably necessary, including in cases involving inventory errors, suspected fraud, payment failure, or unauthorized resale.

Merchandise may be manufactured, fulfilled, shipped, or processed by third-party providers. Shipping dates and delivery estimates are estimates rather than guarantees unless expressly stated otherwise.

Applicable return, replacement, cancellation, shipping, and fulfillment terms presented during checkout or on the relevant product page form part of these Terms.

Charitable character of merchandise purchases

A merchandise purchase is not automatically a charitable contribution merely because the seller is a nonprofit organization. Any deductible portion, if applicable, is generally limited to the amount paid in excess of the fair market value of goods or services received.

Intellectual Property

The website and its content—including text, photographs, videos, audio, graphics, illustrations, symbols, logos, trademarks, service marks, page designs, layouts, animations, written works, recordings, downloadable materials, and compilations—are owned by Joy for Life or used with permission.

“Joy for Life,” “J4L,” “Red Thread,” “Where Purpose Begins,” the Red Thread visual identity, and related branding may not be used in a manner that suggests sponsorship, endorsement, partnership, affiliation, or authorization without prior written permission.

Nothing on the website grants any implied license or right to use Joy for Life intellectual property except the limited website-use permission expressly stated in these Terms.

User Submissions and Feedback

You retain ownership of original material that you lawfully submit to Joy for Life, subject to the rights described in this section.

When you voluntarily submit a testimonial, comment, photograph, video, creative work, story, suggestion, or other material for publication or promotional use, you grant Joy for Life a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, format, publish, display, distribute, and communicate that material for the purpose for which it was submitted.

This license does not authorize Joy for Life to disclose private information contrary to the Privacy Policy.

You represent that you have the rights and permissions necessary to submit the material and that its authorized use will not violate another person’s intellectual property, privacy, publicity, contractual, or other legal rights.

General ideas, suggestions, and feedback may be used without an obligation to compensate you, provided that Joy for Life does not claim ownership of your preexisting intellectual property.

Third-Party Platforms, Links, and Services

The website may link to, integrate with, or rely upon third-party platforms and providers for membership hosting, payments, donations, merchandise fulfillment, shipping, video hosting, email delivery, analytics, social media, forms, and other functions.

Third-party services operate under their own terms, privacy policies, security practices, availability standards, and technical limitations. Joy for Life does not control and is not responsible for independent third-party websites or services.

A link or integration does not necessarily constitute an endorsement of every statement, policy, product, service, or practice of the third party.

Electronic Communications

When you contact Joy for Life, submit a form, establish an account, complete a transaction, or otherwise communicate electronically, you consent to receive communications necessary to administer your inquiry, donation, order, membership, account, or transaction.

Transactional and administrative communications may include receipts, confirmations, security notices, billing notices, account messages, service updates, event information, and responses to requests.

Marketing communications are governed by the choices and unsubscribe mechanisms provided with those messages. Unsubscribing from marketing messages does not prevent necessary transactional or administrative communications.

Privacy and Cookies

Our collection and use of personal information are governed by the Privacy Policy.

Information about cookies, analytics, embedded services, and similar technologies is provided in the Cookie Policy.

These policies are incorporated into these Terms by reference.

Disclaimers

The website and its content are provided for general informational, educational, charitable, and community purposes. Nothing on the website constitutes medical, psychological, psychiatric, therapeutic, legal, tax, accounting, investment, or other individualized professional advice.

Joy for Life does not diagnose, treat, cure, or prevent any medical or mental-health condition through the website. Individuals should obtain appropriate professional advice for decisions requiring clinical, legal, financial, tax, or other specialized judgment.

To the fullest extent permitted by law, the website and related online services are provided on an “as is” and “as available” basis. Joy for Life does not warrant that the website will be uninterrupted, error-free, completely secure, or free from harmful components.

We may revise, suspend, discontinue, restrict, or replace any website feature, publication, program description, membership feature, product, or service without guaranteeing continued availability.

Limitation of Liability

To the fullest extent permitted by applicable law, Joy for Life and its directors, officers, employees, contractors, volunteers, agents, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the website, its content, or online services.

This includes, without limitation, damages relating to loss of data, loss of opportunity, loss of revenue, interruption of service, reliance on website content, unauthorized account access, third-party conduct, or inability to access a service.

Where liability cannot lawfully be excluded, the aggregate liability of Joy for Life arising from use of the website or an online service will not exceed the greater of:

• The amount you paid directly to Joy for Life for the specific transaction or service giving rise to the claim during the preceding six months; or
• One hundred United States dollars.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Joy for Life and its directors, officers, employees, contractors, volunteers, agents, and representatives from claims, liabilities, losses, damages, judgments, costs, and reasonable legal expenses arising from:

• Your material violation of these Terms;
• Your unlawful or unauthorized use of the website;
• Your infringement of another person’s rights;
• Material you submit or distribute through the services; or
• Your fraudulent, malicious, or intentionally harmful conduct.

Suspension, Restriction, and Termination

Joy for Life may investigate suspected misuse and may restrict, suspend, or terminate access when reasonably necessary to protect the organization, its systems, its participants, its members, its community, its intellectual property, or other users.

Termination of access does not eliminate payment obligations, intellectual-property restrictions, confidentiality obligations, liability limitations, indemnification duties, or other provisions that by their nature should survive termination.

Governing Law and Venue

These Terms and any dispute arising from or relating to the website or online services are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

Subject to any applicable law requiring otherwise, legal proceedings arising from these Terms or use of the website shall be brought in the state or federal courts having jurisdiction in Multnomah County, Oregon, and each party consents to the personal jurisdiction of those courts.

Before filing a legal action, the parties are encouraged to provide written notice of the dispute and make a good-faith effort to resolve it informally.

Changes to These Terms

Joy for Life may update these Terms to reflect changes in the website, services, operations, legal requirements, technology, or organizational practices.

When revised, the effective date displayed at the beginning of the Terms will be updated. Material changes may also be announced through the website, account platform, or another reasonable communication method.

Changes apply prospectively from the stated effective date. Continued use after the revised Terms become effective constitutes acceptance of the updated Terms.

General Provisions

Entire agreement

These Terms, together with any policies expressly incorporated by reference and any transaction-specific terms presented at checkout, constitute the applicable agreement concerning use of the website and related online services.

Severability

If any provision is found invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

No waiver

Failure to enforce a provision does not waive the right to enforce that provision or any other provision later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent. Joy for Life may assign these Terms in connection with a lawful restructuring, merger, transfer of operations, or succession of the applicable service.

Headings

Section titles are provided for convenience and do not limit the meaning or scope of the provisions.

No third-party beneficiaries

Except where expressly stated, these Terms do not create enforceable rights for any person or entity that is not a party to them.
